General terms and conditions of business

1. Acknowledgement
The hirer expressly acknowledges the general terms and conditions as an integral part of the hire agreement, in particular the liability for damage caused by the hirer to the hired item or to third-party property, and undertakes to ensure that they are properly instructed on the handling of the hired item.

2. Start and end of the hire period
In the event of being unable to commence the hire or in the event of an unforeseen extension of the hire period, Bebbi Boot GmbH must be notified immediately on 076 225 59 78. If the hired item is not returned by the agreed time, the hirer shall pay for each hour or part thereof.

3. Booking, cancellation and rescheduling terms and conditions for boat hire.
The booking is confirmed upon transfer of the total amount. The skipper must also send Bebbi Boot a copy or photo of their valid boat licence in advance. In the event of cancellation up to 48 hours before the start of the hire period, the full amount (or the deposit paid) will be refunded, minus a cancellation fee of CHF 10. In the event of cancellation of an agreed hire less than 48 hours before the start of the hire period, the hirer owes Bebbi Boot GmbH half of the total hire price. For cancellations made up to 24 hours before the start of the hire period, the full amount will be charged and no refund will be given. Instead of cancelling, bookings can be rescheduled. Please contact us by email (info@boot-cudrefin.ch) stating the
new desired date and time, or call us directly. For last-minute rescheduling less than 48 hours before the start of the hire, a fee of CHF 50.00 will be charged. Rescheduling less than 24 hours before the start of the hire cannot be accommodated. The boat hire must be paid for either via the booking form, via Twint (plus fees) or in advance by bank transfer.
The same rules apply to cancellations and rescheduling as for the hourly boat hire explained above.

4. Briefing
Before the rental begins, the renter must check that all necessary vessel documents and the prescribed minimum equipment are on board. Bebbi Boot GmbH will take the time to provide a professional briefing on the boat and the sailing area before the rental begins. The renter is responsible for acting in accordance with the briefing. The condition of the hire boat shall be discussed at the start and end of the hire period; any existing defects shall be recorded in the condition report.

5. Authorisation to operate the rental boat and rules in the sailing area
Only the renter of the boat, who holds a valid Category A boat licence and is familiar with the applicable regulations in Switzerland, is authorised to operate the rental boat. A copy or photograph of the boat licence must be sent to Bebbi Boot before the start of the rental period. Anyone who does not have their boat licence with them at the start of the rental period may not commence the trip and is not entitled to a postponement or refund of the trip. Practice trips with the rental boat are not permitted. The renter is fully liable for any violations or disregard of regulations. The hirer acts as the skipper and, as such, is responsible for complying with the law and local regulations, in particular:
 

● compliance with the maximum load (number of passengers) as stated in the vessel’s registration certificate
● compliance with the speed limit and the avoidance of wake and wave impact in shore areas
● the regulations governing navigation in harbours and along the shore.
● compliance with all applicable navigation rules in accordance with maritime law.


If a passage through a lock is planned during the hire period, the hirer must obtain permission from Bebbi Boot before the start of the hire.

7. Rental boat

The rental boat is handed over in good condition; fuel and engine oil are checked by Bebbi-Boot GmbH before the trip and topped up if necessary. The hirer undertakes to take good care of the rental boat and to return it in a clean condition. Should any unplanned, exceptional cleaning work be required, this will be carried out by Bebbi Boot GmbH and charged at CHF 80 per hour plus additional material costs.

8. Obligations in the event of an accident
In the event of an accident, the hirer must immediately notify Bebbi Boot GmbH so that the damage and the next steps can be discussed together. In the event of significant property damage or personal injury, the Rhine Police must be contacted immediately. Furthermore, the renter is responsible for drawing up a sketch of the accident and for recording the names and addresses of the persons involved in the accident as well as any witnesses. Verbal or written promises to third parties regarding compensation for injured parties must be avoided.

9. Third-party liability and comprehensive insurance and deposit

In the event of damage, the hirer is liable for an excess of CHF 500. Bebbi Boot may require this to be paid as a deposit at the start of the hire period. If the repair costs are lower than this amount, the balance will be refunded to the hirer once the repairs have been completed. The hirer also remains personally liable
for all damage not covered by the third-party liability and comprehensive insurance (e.g. gross negligence, cut upholstery, defective equipment, defective propeller, damage caused by the anchor, lost items, etc.). Bebbi Boot GmbH accepts no liability whatsoever for personal injury or any associated costs. The hirer and any other guests on the hired boat are responsible for taking out appropriate accident and personal injury insurance themselves.

 

10. Liability for the Cudrefin boat owned by Bebbi Boot GmbH

Bebbi Boot GmbH shall not be liable for any damage that the hirer may incur as a result of a defect in the hired vessel that prevents the journey from continuing, causes a loss of time or results in other consequential damage.
 

11. Repairs

The hirer is obliged to inspect the hired vessel before the start of the hire period. In the absence of any objection, it is assumed that the hired vessel is in good condition at the time of handover. The tenant is liable for any damage occurring during the rental period, as described in points 6 and 7. Necessary repairs must always be carried out by a workshop designated by Bebbi Boot GmbH. No repairs or alterations may be made to the rental property without the consent of Bebbi Boot GmbH.

 

12. Loss of Property

In the event of loss of the lessor’s property (keys, boat hooks, etc.), compensation equivalent to the value of the loss will be charged. The lessor accepts no liability for property left behind by the lessee.

13. Performance of the Contract
In the event that the hire boat cannot be made ready for use between the conclusion of the contract and the start of the hire period, Bebbi Boot GmbH shall be entitled to withdraw from the contract without compensation. In the event of a breach of the contractual provisions by the hirer, Bebbi Boot GmbH may, without further ado, set off the damage incurred against the deposit paid. We expressly reserve the right to make further claims.


14. Supplementary provisions

In addition to these provisions, the Swiss Code of Obligations shall apply.


15. Place of jurisdiction
The place of jurisdiction for the adjudication of all disputes arising from this contract is the registered office of Bebbi Boot GmbH in Basel-Stadt. The tenant expressly declares that, waiving their ordinary place of residence, they submit to the place of jurisdiction agreed herein.
